1. General

These Terms and Conditions govern the rental of vehicles from Boss Auto Rentals. By booking or renting a vehicle from us, the renter agrees to comply with these terms. Boss Auto Rentals reserves the right to refuse a rental at its discretion if the renter does not meet the required conditions.

2. Driver Eligibility

Drivers must be at least 25 years old, hold a valid driver licence, and provide a licence in English or an International Driving Permit with translation if required. Additional per day charge if the driver is 21 years to under 25 years old. Only drivers listed on the rental agreement may drive the vehicle.

3. Rental Period

The rental period begins at the pickup time and date stated in the agreement and ends when the vehicle is returned. Late returns may incur additional charges. Boss Auto Rentals reserves the right to charge additional rental fees if the vehicle is returned after the agreed return time.

4. Payment & Bond

Full payment must be made before or at the start of the rental period. A security bond will be held on the renter’s credit card for the duration of the rental. The bond may be used to cover damage to the vehicle, traffic fines, fuel charges, cleaning fees, or
late return charges. The bond will be released once the vehicle is returned and inspected.

5. Insurance & Excess

All rentals include standard insurance coverage subject to an excess amount.
Typical excess levels: Standard Cover – $5000 excess, Reduced Excess/Medium
cover – $2500, Zero Excess/Full Cover – $500 excess. Insurance may be void if the
renter breaches the rental agreement.

6. Vehicle Use Restrictions

Vehicles must not be used off-road or on restricted unsealed roads, for racing, towing, competitions, transporting illegal goods, or by unauthorized drivers. Smoking inside the vehicle is strictly prohibited. A cleaning fee of up to $150 may apply if the vehicle is returned excessively dirty.

7. Fuel Policy

Vehicles will be provided with a full tank of fuel and must be returned with the same fuel level. If the vehicle is returned with less fuel, cost of fuel plus $20 refueling charges will
apply.

8. Accidents & Damage

In the event of an accident or damage, the renter must inform Boss Auto Rentals immediately, contact police if required, and complete an accident report.
Failure to report an accident may void insurance coverage.

9. Traffic Offences & Fines

The renter is responsible for all traffic infringements, parking fines, and toll charges incurred during the rental period. Administrative fees of $35 may apply for processing fines.

10. Vehicle Condition

The renter agrees to return the vehicle in the same condition as received, with all keys and accessories, and at the agreed location and time.
Damage not noted at pickup may be charged to the renter.

11. Cancellation & Refund Policy

Cancellation policies may apply depending on the booking type.
Refunds are subject to cancellation timing and administrative fees.

11.1. Free Cancellation

Customers may cancel their booking free of charge up to 48 hours prior to the scheduled pickup time. A full refund will be issued for any amount paid.

11.2. Late Cancellation

Cancellations made within 48 hours of the scheduled pickup time will incur a fee equal to one (1) day’s rental charge. Any remaining balance will be refunded.

11.3. No-Show Policy

A booking will be considered a No-Show if the customer:
1. Fails to arrive at the agreed pickup location and time, or
2. Fails to notify Boss Auto Rentals of any delay, or
3. Does not meet the rental requirements at the time of pickup.
In such cases, no refund will be provided.

11.4. Early Return / Unused Rental Days

No refunds will be provided for unused rental days once the vehicle has been collected. Any early return of the vehicle does not entitle the customer to a refund for unused time.

11.5. Booking Modifications

Booking modifications (including changes to dates, times, or vehicle type) are subject to availability. Additional charges or rate changes may apply depending on the revised booking details.

11.6. Refund Processing

Approved refunds will be processed within 3 to 7 business days. The time taken for funds to appear in the customer’s account may vary depending on the payment provider or bank.

11.7. Company-Initiated Cancellations

If Boss Auto Rentals is unable to provide the booked vehicle due to unforeseen circumstances (including but not limited to mechanical issues or operational constraints), the customer will be offered:
1. A suitable replacement vehicle (subject to availability), or
2. A full refund of any amount paid

11.8. Cancellation Method

All cancellations must be submitted via email or the official booking channel and must be acknowledged and confirmed by Boss Auto Rentals to be considered valid.

12. Liability

Boss Auto Rentals shall not be liable for loss of personal belongings, delays due to mechanical failure or unforeseen circumstances, or indirect or consequential losses.

13. Compliance with New Zealand Transport Laws

These Terms & Conditions are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the courts of New Zealand. The renter agrees to always comply with all applicable New Zealand transport laws, regulations, and codes, including but not limited to:

  1. The Land Transport Act 1998
  2. The Land Transport (Road User) Rule 2004
  3. The Land Transport (Driver Licensing) Rule 1999
  4. The Land Transport (Offences and Penalties) Regulations 1999
  5.  The Land Transport Rule: Vehicle Standards Compliance 2002
  6. All applicable rules and guidance issued by Waka Kotahi NZ Transport Agency
Driver Responsibilities

The renter and any authorized driver must:

  1.  Not operate the vehicle under the influence of alcohol or drugs

  2.   Drive in accordance with all road rules, speed limits, and traffic signs

  3.  Ensure all passengers wear seatbelts at all times
  4.  Comply with all driver licensing requirements applicable in New Zealand
  5.  Ensure child restraints comply with New Zealand legal requirements

Liability for Breaches

  •  The renter is fully responsible for any fines, penalties, infringements, or legal
    breaches incurred during the rental period
  • Any breach of New Zealand transport laws may result in:

          1.  Immediate termination of the rental agreement
          2. Loss of insurance cover
          3. Full liability for all damages and associated costs
